Terms of Service

Please read these Terms of Service carefully before using Menu Mate. By downloading or using Menu Mate, you agree to be bound by these Terms.

1. Acceptance of Terms

By using Menu Mate, you confirm that you are at least 13 years of age (or 16 in the EEA) and have the legal capacity to agree to these Terms.

2. Description of Service

Menu Mate is a restaurant discovery and dining budget planning application. It allows users to:

• Search restaurants, dishes, and menus by name, price, cuisine, location, and dietary filter.
• Use the Pre-Dining Budget Calculator to estimate itemised costs (including tax and tip) before dining out.
• Save and name dining plans for future visits.
• Share dining plans with friends via a temporary link.
• Contribute menu data by submitting photographs of physical menus.
• (For restaurant owners) Manage and update menu listings via the Admin Dashboard.

3. User Accounts

To access certain features, you must create an account. You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately if you suspect unauthorised access.

4. User Conduct

You agree not to use Menu Mate to:

• Submit false, inaccurate, or misleading menu data or restaurant information.
• Submit menu photos that are blurry, irrelevant, or contain inappropriate content.
• Scrape or use automated means to extract data from the app without prior written permission.
• Claim ownership of a restaurant you do not own or manage.
• Circumvent any technical measures designed to protect the app or its data.
• Use the app for any commercial purpose (e.g., reselling restaurant data) without our express written consent.
• Violate any applicable law.

5. Menu Contribution Policy

By submitting a menu photo or data, you:

• Confirm you are physically present at the restaurant or have legitimate access to the menu.
• Grant us a perpetual, irrevocable, non-exclusive licence to use, store, process, and display the contributed data within Menu Mate.
• Acknowledge that submitted data will be reviewed and may be rejected or modified for accuracy.
• Understand that contributions may be attributed to your account for quality tracking.

6. Restaurant Owner Features

If you register as a restaurant owner or manager, you additionally agree to:

• Provide accurate verification information during the ownership claim process.
• Only manage listings for establishments you are lawfully authorised to represent.
• Ensure that menu data you publish is accurate and up to date.

We may revoke owner access if inaccurate or misleading information is discovered.

7. Accuracy of Menu & Price Data

Menu data is sourced from community contributions and manual data entry. We do not guarantee that menu prices, items, or availability are current or accurate. Always verify with the restaurant directly before making a purchase decision.

The Pre-Dining Budget Calculator provides estimates only. Actual restaurant bills may differ due to pricing changes, seasonal specials, surcharges, or regional tax variations not reflected in our data.

8. Shared Dining Plans

When you share a dining plan, you are responsible for who you share the link with. Anyone with the link can view and (if enabled) modify the plan. We are not responsible for disputes between plan participants arising from modifications.

9. Intellectual Property

The app, including its software, design, database structure, and non-user-contributed content, is the property of Obsidian Prime. You may not copy, scrape, reverse-engineer, or resell any part of the platform, or use restaurant/menu data for commercial purposes without written authorisation.

10. Third-Party Services

The app integrates with Mapbox for maps. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

11. Disclaimers

The app is provided on an "as is" basis. We make no warranties regarding the accuracy of restaurant or menu data, availability of the service, or fitness for any particular purpose.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for inaccurate menu prices, any indirect or consequential damages arising from your use of the app, or any financial decisions made based on the Pre-Dining Budget Calculator estimates.

13. Indemnification

You agree to indemnify and hold harmless Menu Mate and Obsidian Prime from any claims, damages, or expenses arising from your use of the app, your submitted content, or your violation of these Terms.

14. Termination

We reserve the right to suspend or terminate access at any time, without notice, for conduct that violates these Terms or is harmful to other users or the platform.

15. Changes to Terms

We may revise these Terms at any time. Continued use of the app constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by applicable law. Disputes shall be subject to the exclusive jurisdiction of the relevant courts.
