Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Between Us mobile application. By downloading or using Between Us, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Between Us, you confirm that you are at least 18 years of age and have the legal capacity to agree to these Terms.

2. Description of Service

Between Us is a social party game application that allows groups of people to play truth-or-dare style games in shared, real-time sessions. Features include voice rooms, in-session chat, screenshot protection, and interactive game prompts.

3. User Conduct

You agree not to use Between Us to:

• Harass, bully, intimidate, or harm other participants.
• Share, display, or transmit any content that is unlawful, offensive, defamatory, obscene, or otherwise objectionable.
• Impersonate any person or entity, or misrepresent your identity.
• Attempt to gain unauthorised access to any part of the app or its servers.
• Record other participants' audio or video without their explicit consent.
• Use the app for any commercial purpose without our express written consent.
• Violate any applicable local, national, or international law.

We reserve the right to terminate your access to the app if you violate these conduct rules.

4. User-Generated Content

Within game sessions, you may share display names, voice notes, and participate in in-session chat ("User Content"). You are solely responsible for any User Content you produce. By using the app:

• You confirm you have the right to share the content you produce.
• You grant us a limited, non-exclusive licence to transmit your User Content to other session participants in real time for the purpose of operating the Service.
• You acknowledge that all User Content is ephemeral and not stored after a session ends.

5. Intellectual Property

The app, including its design, graphics, code, and game content, is the property of Obsidian Prime and is protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the app without express written permission.

6. Third-Party Services

The app integrates with Agora.io for real-time voice and video. Your use of those services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

7. Disclaimers

The app is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app — including any harm caused by content shared by other users.

9. Indemnification

You agree to indemnify and hold harmless Between Us and Obsidian Prime from any claims, damages, losses, disputes, or expenses (including legal fees) arising out of your use of the app or your violation of these Terms.

10. Termination

We reserve the right to suspend or terminate access to the app at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We may revise these Terms at any time. We will notify you of significant changes by updating the "Last updated" date. Your continued use of the app following any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the relevant courts.
